Can I complain to the Arizona Ombudsman Citizens’ Aide about Section 8 or The United States Department of Housing (HUD)

No.The United States Department of Housing (HUD) is a federal agency. We do not have jurisdiction over federal agencies, even if it is a local branch in the state of Arizona. Section 8 is a federal program, so we also cannot take complaints about Section 8. Please see the Section 8/HUD website for more information, or call 800) 955-2232.

How can I obtain a copy of the Landlord Tenant Act?

Are there any state agencies that govern Homeowners Associations?

No. Homeowners Associations (HOAs) are not regulated by a state government agency. Since they are not governmental public bodies, they are not subject to Arizona’s Open Meeting Law.  The statutory requirements governing Homeowners Associations are provided in ARS § 33-1801 et seq.

There is a HOA dispute process which is handled by the Department of Real Estate. In 2011, the Arizona Legislature passed legislation providing Arizona homeowners and condominium and planned community associations (HOA’s) a venue for resolving disputes. These administrative procedures provide an alternative to the civil court system and do not limit the legal rights of the parties to further pursue matters. In 2016, the Arizona Legislature passed legislation moving the Homeowners Association (HOA) Dispute Process to the Arizona Department of Real Estate (ADRE). The Arizona Office of Administrative Hearings (OAH) will accept all cases as referred by the ADRE, and schedule a Hearing date before an Administrate Law Judge (ALJ). There is a filing fee involved.
